I have filed my taxes with H&R Block for years, I am just your average professional with a wife and daughter who is still in high school; I never saw a reason for to pay for a "professional" tax prepare-er. Well due to some investing I did about 3 years ago I had developed a $11,000 Income Tax Debt according to H & R Block; they recommended calling the IRS and setting up an installment agreement. So I did... $250 per month! and about 2 years later I still owed $7,000!!! around the same time I realized how much interest & penalties I was paying I had heard a advertisement on The Sean Hannity Radio program for Tax Results and decided to call. I was very skeptical about settling with the IRS, but they were very honest in explaining that I could not "settle" my debt because I make decent money and have some financial assets... they did however want to check out the income tax returns surrounding the $11,000 debt I had incurred and ended up finding out that H&R block had not filed the transactions correctly or had missed some deductions I was eligible for? All of it really confuses me, but my rep had made it pretty simple; they amended 3 of my past income tax returns and followed up with the IRS for about 3 months until the changes registered. I ended up with a $4,000 check back from the IRS for over payment and the $7,000 balance was erased! Putnam County Market Owners Arrested for Sales Tax Evasion and Theft

FRIDAY, AUGUST 10, 2012 | 10:44 AM

Nashville - The Special Investigations Section of the Tennessee Department of Revenue conducted the investigation that led to today’s arrest of two Putnam County market owners on charges of sales tax evasion and theft. Punit Rajendra “Nick” Patel, age 25, Corporate Officer of Yogeshwari, Inc., d/b/a PFS Market located in Baxter, Tennessee, was arrested on August 9th at his home by Special Agents of the Tennessee Department of Revenue.  Nainesh C. Patel, age 45, President of HAS, Inc., d/b/a Discount Tobacco & Beer Mart located in Cookeville, Tennessee, was also arrested on August 9th at the business by Putnam County Sheriff’s officers. 

On August 6, 2012, both men were indicted by the Putnam County Grand Jury on multiple Class E felony counts of sales tax evasion in violation of Tenn. Code Ann. Section 67-1-1440(g) and one Class C felony count of Theft of Property over $10,000 in violation of Tenn. Code Ann. Section 39-14-103.  The indictments charge Punit Patel with willfully attempting to evade or defeat sales tax totaling $26,692.34 during the period Jun. 2007 through Dec. 2008 and Nainesh Patel with willfully attempting to evade or defeat sales tax totaling $24,648.28 during the period of February 2006 through September 2007. 

“I believe these investigations will serve as a reminder that retailers are not entitled to use or keep sales tax monies,” said Revenue Commissioner Richard H. Roberts. “When sales tax revenues are collected by a retailer they are at all times property of the state or local government and must be remitted to the state. Consumers who pay the tax deserve to know that the money will be used by the state and local governments for the common good.” 

If convicted, the men could be sentenced to a maximum of two years in the state penitentiary and fined up to $3,000 for each count of attempted sales tax evasion and a maximum of six years in the state penitentiary and fined up to $10,000 for theft of property. 

This case was pursued criminally by the department in cooperation with District Attorney General Randy York’s office. Citizens who suspect violations of Tennessee’s revenue laws should call the toll-free tax fraud hot line at (800)FRAUDTX (372-8389). 

In addition to collecting state taxes, over $2.0 billion of local sales and business taxes were collected by the department for local governments during the 2012 fiscal year.  Besides collecting taxes, the department enforces the revenue laws fairly and impartially in an effort to encourage voluntary taxpayer compliance.  The department also apportions revenue collections for distribution to the various state funds and local units of government. “The interest rates announced today are computed from the federal short-term rate determined during April 2012 to take effect May 1, 2012, based on daily compounding.

Revenue Ruling 2012-16, announcing the rates of interest, is attached and will appear in Internal Revenue Bulletin No. 2012-26, dated June 25, 2012.”

“The rates will be:

one-half (0.5) percent for the portion of a corporate overpayment exceeding $10,000.”

IRS Statute of Limitations, Currently Not Collectible, Wage Garnishment, Installment Agreement (Posted on: May 10, 2012 @3:16 pm)

A client from California who is a skilled tradesman had developed nearly $10,000 in income tax debt with the IRS all the way back in the late ninties.   The IRS began automated collection efforts in 2002 and finally started garnishing 58% of the gentlemans wages in 2012 when he had again defaulted on various small payment arrangements he had made with the IRS.   The 58% garnishment that was imposed by the IRS left the gentleman with less than $400 per month in income; because of good friends, family, a wife who earned some money doing odd jobs and a small pension the couple was able to get by. 

After the gentleman contacted and retained Tax Results our Enrolled Agents where able to communicate with the client and the IRS one on one to work out a resolution to the current problem of the 58% wage garnishment as well as a solution to the remaining $10,000 debt.   

The Tax Results production staff was again successful in getting the taxpayer and client deemed Currently Not Collectible.  This is also know as CNC Status.   Once the client was deemed Currently Not Collectible by the IRS our Enrolled Agents where able to lift the clients wage garnishment which in turn allowed him to receive 100% of his paycheck again.   Further, the client is now protected from suffering any additional Enforced Collection Efforts by the IRS such as Bank Levy, additional Tax Liens, property seizure and additional wage garnishments.   The client will reap the benefit of this status and protection for a minimum of 36 months provided their financial situation does not drastically improve before then.

Not having to repay the IRS through a monthly installment agreement without worrying about Enforced Collection Efforts or even Automated Collection Efforts is obviously a huge relief for the client.  But more interesting yet, while the client is under the protection of Currently Not Collectible Status better than 90% of their remaining tax liability will expire under the Statute of Limitations in a few months.  What this means is that this Tax Results client started out with Tax Results having about a $10,000 debt to the IRS and a 58% wage garnishment and now not only has had his wage garnsishment lifted, he does not have to repay the IRS monthly and in a few months will only have an $800.00 debt to the IRS that he will be able to pay back in small monthly installments.

We just received a phone call from a taxpayer who owes the IRS approximentally $15,000.00.  She has been making $350 per month payments to the IRS and has found that the total amount she owes isn't going down.  

Whats happening is simple.... Like a credit card she is only paying the penalties and interest!

Because she barley makes enough money to pay her bills and because she dosen't own anything that is worth money she is not eligible for a hardship program to elimiate her monthly installment agreement, she is even likley to be eligible for an Offer In Compromise; 

YES! she can likley settle the debt for much less than the amount owed.  Tax Results just recently completed an Offer In Compromise for a smiliar client who owed a little more than $12,000.  That Tax Results client only ended up paying a total of $1,000 to the IRS.
